Recently, VSLO won a major victory on behalf our client, the British Columbia Teacher’s Federation, in a challenge to provincial legislation which limited teachers’ bargaining rights. Similar legislation had previously been found to be unconstitutional, but the government’s response had been to pass almost identical legislation.

In a decision released on January 27, 2014, Madam Justice Griffin

  • found the government in continuing breach of the Charter rights of teachers
  • awarded $2 million for breach of Charter rights
  • provided teachers with the ability to challenge breaches of the collective agreement from June 2002
