LABOUR LAW

The foundation of Victory Square Law Office LLP’s practice, and its predecessor Baigent, Jackson, Blair, has always been labour law. Our firm includes a former Board Vice Chair and we have extensive experience in representing unions in all Labour Relations Code matters and applications including strikes, lockouts, arbitration award reviews, unfair labour practice complaints, duty of fair representation complaints, certifications, decertifications, raids, successorship and common employer applications and essential service designations in both the public and private sectors. In addition to the B.C. Labour Relations Board, we have experience representing unions in the federal jurisdiction at the Canada Industrial Relations Board, including labour disputes on First Nations Lands.

The majority of our practice is providing representation to trade unions in all grievance arbitration matters from the initial assessment of the merits of grievances and advising unions on settlement possibilities through to arbitrations and review of arbitration awards. We have extensive experience representing Unions in arbitrations involving collective agreement interpretations contracting out issues, complex discipline and discharge grievances involving employees with drug and alcohol addictions, employees accused of abuse, harassment, and assault, duty to accommodate issues, promotions, selections, pensions and benefits, and arbitrations involving tort claims and the application of legislation.

We provide advice to unions on collective bargaining issues and strategies, bad faith bargaining complaints, and provide advice on specific collective agreement language.

We provide immediate assistance on urgent labour injunction applications in court and at the Labour Relations Board including issues involving strikes, lockouts, and picketing.
