EMPLOYMENT LAW
We exclusively represent employee’s interests in non-unionized employment matters involving claims of unlawful discrimination, harassment, unjust dismissal, dismissal without reasonable notice and constructive dismissal. Our decision to limit our inter-provincial employment law practice to representing employees’ rights distinguishes us from other law firms. Some employment law lawyers purport to practice employee-side employment law, while the major focus of their day-to-day law practice is ensure that employers’ rights trump those of employees. By restricting our practice to representing only employees, our goal is to advance and protect employees’ legal rights.
We provide legal advice to workers, professionals, and managerial or excluded employees to assist them to define, advance or defend their rights in a broad range employment law matters including:
- review and drafting of employment contracts;
- Employment Standards Code claims;
- defense of professional employees in proceedings before professional disciplinary bodies;
- strategic legal advice in anticipation of termination of employment;
- legal advice and representation in claims of unlawful discrimination, including duty to
- accommodate claims, under human rights legislation and the Canadian Charter of Rights and Freedoms;
- harassment, including sexual harassment claims, under human rights legislation and the Canadian Charter of Rights and Freedoms;
- providing independent legal advice in relation to employment severance offers;
- constructive dismissal claims; and
- wrongful dismissal claims (dismissal without just cause and without reasonable notice or payment in lieu of reasonable notice).
We strive to provide legal advice at a reasonable cost to employees, because in our experience, without competent legal advice, employees unnecessarily spend valuable time and money commencing legal proceedings in an improper forum. This could be an irreversible error if the legal claim is not commenced in a timely manner in the correct forum. Our experience also shows us that employees often find it difficult to distinguish between unlawful and lawful discrimination in employment. Without obtaining timely and competent legal advice, an employee’s legitimate legal claim may be defeated. Sebastien Anderson and Jitesh Mistry are registered by the Canadian Bar Association’s Lawyer Referral Service to provide employment law legal advice. As such, they provide an initial consultation at a reduced legal fee in accordance with the fee structure established by the Canadian Bar Association Lawyer Referral Service.
