CIVIL LITIGATION
We recognize that unions and workers occasionally require assistance in dealing with litigation in the courts. In particular, we have experience in representing unions in defamation and breach of contract actions, in judicial reviews and appeals, in enforcing arbitration awards through contempt proceeding, and in internal union matters involving union constitution and bylaws and membership issues. We also represent unions and individuals on short notice on urgent injunction applications involving labour disputes.
Additionally we represent individual employees in employment and wrongful dismissal claims, long term disability claims, and other workplace concerns.
We have extensive experience in pursuing judicial reviews of arbitration awards, tribunal decisions, and government actions in the BC Supreme Court and the BC Court of Appeal. We also represent clients in judicial reviews in the Alberta Courts, the Federal Courts, and the Supreme Court of Canada.
We recognize that an employer’s financial difficulties often have profound affects on the rights of employees. We have experience in representing and advising unions in employer bankruptcy and Companies Creditors’ Arrangement Act proceedings.
